Valuable Information from NYC DEP-

1) Industrial Wastewater Discharge Permit – permit is generally valid for five years,
after which renewal is required.  Refer to your individual Wastewater Discharge
Permit for sampling, reporting and other requirements (for more information call
NYCDEP’s Bureau of Wastewater Treatment, Division of Pollution Control &
Monitoring at 718-595-4712; see also “Rules of the City of New York, Title 15, Chapter
19”)

2) Certificate of Operation for Industrial Processes (including co-generation
systems)  – must be renewed every three years; send “Application to Renew
Registration or Operating Certificate” (Form 314C) no later than 90 days prior to the
expiration of the certificate to NYCDEP, Bureau of Environmental Compliance,
Records Control, 59-17 Junction Blvd,. 9th Floor, Flushing, NY 11373-5108 (for more
information call the NYCDEP Records Control Division at 718-595-3855; see also
“New York Administrative Code, Title 24, Chapter 1”)

3) Certificate of Operation for Fuel Burning Equipment (e.g. boilers) – must be
renewed every three years; send Form BO-9, “DOB Boiler Inspection Report/DEP
Boiler Renewal Request” (see
http//nycgov/html/dep/html/forms_and_permits/index.shtml) no later than 90
days prior to the expiration of the certificate to the NYC Department of Buildings,
280 Broadway, 6th Floor, New York, NY 10007 Attention CFB – Boilers (for more

York Administrative Code, Title 24, Chapter 1”)

5) Community Right-to-Know Facility Inventory Form – must be submitted annually
to NYCDEP by March 1 via the online Tier II Filing system ( www.nyc.
gov/dep/tier2filing) or via mail to Right-to-Know/LEPC, NYCDEP, 59-17 Junction
Boulevard, 1st Floor Low Rise, Flushing, NY 11373-5108 (for more information call
NYCDEP’s Bureau of Environmental Compliance, Right-to-Know Program, at 718-
595-4659; see also the “Rules of the City of New York, Title 15, Chapter 41”)
Risk Management Plan (RMP) – must be submitted annually by March 1 to NYCDEP,
Division of Emergency Response & Technical Assessment, Right-to-Know Program,
59-17 Junction Boulevard, 1st Floor Low Rise, Flushing, NY 11373-5108.  Responsible
parties that have previously filed a RMP approved by NYCDEP may also file
annually (by March 1):

6) An update of the previously submitted RMP with a description of any changes in a
facility’s process or change in the surrounding community that requires the facility
to amend the RMP to remain in compliance with the New York City Rules or,
A signed affidavit attesting that no change occurred at a facility or in the community
surrounding a facility, which required that the facility amend its Risk Management
Plan to remain in compliance. (For more information call DEP’s Division of

of the City of New York, Title 15, Chapter 41” including sec. 41-08(e) which pertains
to who must prepare the Risk Management Plan)

7)     Backflow Prevention Devices – A New York State certified backflow prevention
device tester must inspect and test the backflow prevention device(s) at least once a
year.  The results of this test must be sent on form “GEN 215B” to DEP’s Division of
Permitting and Connections, 59-17 Junction Boulevard, 3rd Floor Low-Rise,
Flushing, NY 11373-5107 (please visit the DEP website at http://www.nyc.
gov/html/dep/html/forms_and_permits/wsforms.shtml for more forms and
information.  

Note: your facility may be required to obtain additional NYCDEP permits, approvals
etc. depending upon the operations at your facility.
